Agreeing to these terms

These terms cover your use of this website and any work you ask Sterling Stone Tiburon Concrete to do. By using the site, calling us or sending the contact form, you agree to them. If you don't agree, please don't use the site.

When we take on a job, we give you a written agreement for that job. If the written agreement and these terms disagree, the written agreement wins for that job.

What we do

Sterling Stone Tiburon Concrete is a concrete contractor in Tiburon, CA, working in Tiburon and the cities around it. We build and repair driveways, patios, sidewalks, steps, slabs, footings, foundations, retaining walls and other concrete work. You can read more about our crew on the About page.

Descriptions of our services on this website are general. They aren't a promise that a particular service fits your property. The scope of your job is whatever your written agreement lists, and nothing more.

Estimates and pricing

Estimates are free and come with no obligation. We base each one on what we can see on site, such as the size of the area, access for trucks and equipment, the condition of the old concrete and the ground under it, drainage and the finish you choose.

An estimate is our best figure for the work as we understand it on the day we look. Some conditions only show up once the old slab is out, like soft or wet ground, buried roots, old footings or pipes. If we find something that changes the work or the price, we stop, explain it to you and get your written approval before we go on.

Unless the estimate says otherwise, it's good for 30 days, because material and labor costs can change.

Scheduling, weather and cancellation

We give you a start date when you approve the job, and we do our best to keep it. Rain, extreme heat, delays from suppliers or inspectors, and changes you ask for can move the schedule, because pouring in the wrong conditions leads to a weak slab. We'll tell you as soon as we know a date has to move.

If you need to cancel or reschedule, call us at (415) 429-4397 as early as you can. If you cancel after we've ordered materials or started work, you pay for materials we can't return and the work already done. Your written agreement may set out other cancellation rights, including any that California law gives you, and those rights still apply.

Payment

Your written agreement sets out the deposit, if any, the payment schedule and the ways you can pay. Any deposit or progress payment we ask for will follow California law for home improvement contracts.

Final payment is due when the work in the agreement is done, even if the concrete is still curing, which is the waiting time before it's ready for full use. If a payment is late, we may pause work until it's paid, and you'll owe any reasonable costs we have to spend to collect it.

Your part of the job

You agree to give our crew safe access to the work area and to tell us about anything we should know, such as buried sprinkler lines, septic parts, drainage problems or property line questions. We aren't responsible for damage to buried items you didn't tell us about and that utility locating didn't mark.

Your written agreement says who arranges any permit the job needs. After the pour, you agree to keep people, pets and vehicles off the new concrete for the time we tell you, because using it too early can mark or crack it.

Our guarantee and what it doesn't cover

We're fully licensed and insured, and our work is backed by our satisfaction guarantee. If something about our workmanship isn't right, call us and we'll come look at it and make it right under the terms in your written agreement.

Concrete is a natural material, and some things are normal and not defects. Fine surface cracks, small shade differences between pours, and color or texture variation in stamped or decorative work are common. We cut control joints, which are grooves that give the slab a planned place to crack, but they guide cracks rather than prevent every one.

Our guarantee doesn't cover damage from ground movement, earthquakes, tree roots, heavy vehicles or loads beyond what the slab was built for, deicing salts, harsh cleaners, poor drainage you control, or repairs or changes made by someone else. Apart from what we promise in writing, we make no other warranties, express or implied, to the extent the law allows.

Limits on our liability

To the extent California law allows, Sterling Stone Tiburon Concrete isn't liable for indirect or consequential losses, such as lost use of your property, lost income or delay costs. Our total liability for any claim about a job is limited to the amount you paid us for that job.

Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for our own gross negligence or willful misconduct.

Using this website

The information on this site, starting from the home page, is general information about concrete work and our services. It isn't engineering, legal or permit advice for your property, and it can change without notice. Photos show past work and are examples, not a promise of how your job will look.

The text, photos and design of this site belong to Sterling Stone Tiburon Concrete. Please don't copy them for business use without our written permission.

Settling a disagreement

If you're unhappy with anything, call us first, because most problems get sorted out quickly once we're standing at the slab together. If we can't settle it that way, we both agree to try mediation with a neutral mediator before going to court, unless the law lets either of us skip that step.

If a dispute does go to court, it will be heard in the courts of Marin County, California, unless the law requires otherwise.

Governing law

These terms and any work we do for you are governed by the laws of the State of California.

Changes to these terms

We may update these terms from time to time, and the version on this page is the current one. Changes don't affect a written agreement you've already signed.

If you have a question about these terms, call (415) 429-4397 or reach us through our Contact page. We respond within 1 business day.
